What’s New?
Previously, foreign nationals in Canada looking to switch employers or roles had to wait for their new work permits to be fully processed before beginning their new jobs. This process often caused unnecessary employment gaps for workers and delays for employers in need of immediate staffing. Under the updated policy, qualifying foreign workers who are changing jobs or employers will now be able to begin their new employment while their work permit application is still being processed.
This policy applies to individuals who:
- Hold maintained status but are restricted to a specific employer under their expired permit;
- Have a valid employer-specific work permit but need to change employers due to reasons such as layoffs, role changes, or career advancement;
- Are work-permit exempt for their current position but require a permit for the new role.
Eligibility Requirements
To benefit from this temporary policy, foreign nationals must:
- Be physically in Canada with valid temporary resident status.
- Have submitted a new or renewal work permit application to work for a new employer or in a new occupation.
- Have included a job offer in their work permit application under the Temporary Foreign Worker Program (TFWP) or International Mobility Program (IMP).
- Apply for the public policy exemption through official IRCC electronic channels or alternative formats if needed.
- Formally request that the exemption applies until a final decision is made on their new work permit.
Once approved, the exemption will allow them to start their new job immediately, instead of waiting weeks or even months for permit processing.

- Employers can fill urgent vacancies more quickly using candidates who are already in Canada and ready to work.
- It also ensures that Canada remains competitive by retaining talent and keeping its temporary workforce active and responsive to labour market needs.
Policy Duration
This new measure replaces the COVID-19 era version of the same policy, originally introduced in May 2020, and will come into effect 12 weeks after the signing date. It will remain in place until officially revoked by the Minister of Immigration.
